General Terms of Service – World DMC

These Terms of Service (“Agreement”) define the terms under which you (“Client”, “you”, “your”) engage with World DMC (“Company,” “we,” “our,” “us”) and use our website, products, and services. By accessing our services or website, you agree to these terms. If you do not accept them, please refrain from using our services.

1. Services Provided

World DMC offers digital solutions including but not limited to:

  • Website design and development

  • Mobile and web application development

  • Cloud and hosting services

  • SEO and digital marketing

  • Technical support and maintenance

2. Fees and Payments

  • All service charges are outlined in project proposals or agreements.

  • Fees are payable in advance or as per the payment schedule agreed.

  • All payments are non-refundable unless otherwise stated in a written agreement.

3. Intellectual Property

  • All original content and code developed by World DMC remain our intellectual property unless explicitly transferred upon final payment.

  • Clients are granted a license to use the deliverables solely for their business use.

4. Limitation of Liability

  • World DMC shall not be held liable for any loss, direct or indirect, arising from the use of our services or any technical issues beyond our control.

  • Our liability is limited to the amount paid for the specific service in question.

5. Termination

We may suspend or terminate services if any terms are breached, with or without notice.

6. Governing Law

This Agreement is governed by the laws of Mumbai, India, and any disputes will fall under the jurisdiction of its courts.

1. Project Terms & Conditions

  • Quotes are based on the initial scope and understanding provided. Changes to project requirements may affect costs and timelines.

  • Client approvals (email/verbal/payment) constitute agreement to terms.

  • Clear communication of all features and expectations is required. Lack of clarity may result in additional charges.

  • Complex functionalities should be disclosed during quotation.

  • We allocate reasonable hours for each task, including strategy and project management.

  • Delays from the client’s side may extend timelines and may incur additional costs.

  • Bug reports during development are resolved without extra charge.

  • Post-approval changes or new requests are billable separately.

  • All content must be provided within 14 days from project initiation. Extended delays may affect delivery.

  • Websites are tested on recent desktop browsers and major mobile devices. Specific device testing must be requested in advance.

  • Projects hosted outside World DMC servers may require extra time and charges due to third-party limitations.

  • If a project is paused for more than 3 calendar months, an admin fee of $100/week will apply.

  • Source code ownership is retained by World DMC unless otherwise agreed. Usage beyond the agreed scope, including resale, is not permitted.

  • Any proprietary CMS, themes, or plugins developed by World DMC cannot be transferred or modified unless licensed explicitly.

2. Website Maintenance Terms & Conditions

These terms apply to all support, SEO, and website maintenance services provided by World DMC.

1. Scope of Services

  • Includes bug fixing, updates, performance monitoring, and support.

  • SEO work applies only if purchased as part of a package.

  • Backups are provided for hosted clients; self-hosted clients must handle backups unless otherwise agreed.

2. Service Fees

  • All maintenance fees are outlined in service agreements.

  • Payment frequency and terms are agreed in advance.

3. Client Responsibilities

  • Clients must supply necessary login details and support documentation.

  • Timely collaboration and accurate data provision are essential.

  • Clients are solely responsible for their content legality and security.

4. Provider Obligations

  • Services will be delivered with professionalism and best-effort practices.

  • Third-party conflicts or malware-related issues are not covered unless separately agreed.

  • Our help in third-party issues is on a case-by-case basis and may incur additional fees.

5. Intellectual Property

  • Client retains ownership of all personal content and assets provided.

  • World DMC may showcase client work in portfolios unless otherwise requested.

6. Liability and Indemnity

  • World DMC is not responsible for damages arising from hosting issues, plugin errors, or client misuse.

  • Clients agree to hold World DMC harmless from third-party claims resulting from content or usage.

7. Termination

  • Either party may terminate the agreement with written notice.

  • Services performed up to termination date must be paid for in full.

3. Hosting Terms & Conditions

Hosting Plans & Renewal

  • Hosting is billed annually in advance unless covered under a separate maintenance package.

  • Clients are responsible for renewing their plans before expiry. Late renewal may result in data loss or account termination.

  • Hosting renewal is due at least 7 working days before expiration.

Server Responsibility

  • Hosting is managed via third-party providers.

  • World DMC ensures system protection but does not guarantee complete immunity from external threats.

Hosting Data Management

  • Clients must maintain backups, ensure script security, and manage passwords responsibly.

  • World DMC may delete harmful or malicious files without prior notice.

Cancellation

  • Cancellations must be submitted in writing 30 days before renewal.

  • Renewed hosting is non-refundable.

  • Disabled or expired hosting accounts may be permanently deleted along with all data.

Custom CMS Use & Access

  • World DMC’s CMS is proprietary and licensed only for use on our hosting platform.

  • Transfer of CMS, access to backend code, FTP, or control panels is not allowed unless otherwise licensed.

Emails

  • Email usage must comply with server policies.

  • Quotas should be monitored. Emails older than 6 months may be deleted during server maintenance.

  • Spam or misuse may result in account suspension without notice.

Note: These policies are subject to periodic updates. Continued use of services implies acceptance of the most recent terms. For legal compliance or custom clauses, please consult with a legal advisor to tailor these to your needs.
